Sukhi Play

The licence

Sukhi Play Personal Use Licence 1.0

It covers Sukhi Play and Sukhi Colouring from 2.1 on, and Jazz's Studio. Versions up to and including 2.0.2 were released under the MIT licence and remain under it. The names and the character artwork, Sukhi's and Jazz's, are not covered at all. Improvements are welcome: send them back.

Acceptance

In order to get any licence under these terms, you must agree to them as both strict obligations and conditions to all your licences.

The licensor grants you a copyright licence for the software to do everything you might do with the software that would otherwise infringe the licensor’s copyright in it for any permitted purpose. However, you may only distribute the software according to Distribution Licence and make changes or new works based on the software according to Changes and New Works Licence.

Distribution Licence

The licensor grants you an additional copyright licence to give copies of the software to other individuals, free of charge, for their own permitted purposes. Your licence to distribute covers giving the software with changes and new works permitted by Changes and New Works Licence. It does not cover charging anything for a copy, or distributing the software as part of, alongside, or to promote anything offered for a commercial purpose.

Notices

You must ensure that anyone who gets a copy of any part of the software from you also gets a copy of these terms or the URL for them above, as well as copies of any plain-text lines beginning with Required Notice: that the licensor provided with the software. For example:

Changes and New Works Licence

The licensor grants you an additional copyright licence to make changes and new works based on the software for any permitted purpose.

Patent Licence

The licensor grants you a patent licence for the software that covers patent claims the licensor can license, or becomes able to license, that you would infringe by using the software.

Permitted Purpose

The only permitted purpose is personal use by an individual, for that individual and the members of their own household or family, without any commercial purpose. Setting the software up for your own children, changing it for your own family, and studying how it works are all personal use.

Not Permitted

Nothing else is a permitted purpose. In particular, none of these is a permitted purpose, whether or not anyone pays, and whatever the source of any funding:

  • any commercial purpose, including selling the software, charging for access to it, showing advertising in or around it, collecting data through it, or using it in, with, or to promote any product or service;

  • use by or on behalf of any organisation, including any company, school, nursery, childcare provider, charity, club, religious organisation, or government body, and use by an individual acting for one; and

  • making the software, or anything based on it, available over a network to anyone outside your own household or family.

Names and Artwork

These terms do not grant any licence to the names Sukhi Play or Sukhi Colouring, to any logo, or to the Sukhi character artwork.

Fair Use

You may have “fair use” or “fair dealing” rights for the software under the law. These terms do not limit them.

No Other Rights

These terms do not allow you to sublicense or transfer any of your licences to anyone else, or prevent the licensor from granting licences to anyone else. These terms do not imply any other licences.

Patent Defence

If you make any written claim that the software infringes or contributes to infringement of any patent, your patent licence for the software granted under these terms ends immediately.

Violations

The first time you are notified in writing that you have violated any of these terms, or done anything with the software not covered by your licences, your licences can nonetheless continue if you come into full compliance with these terms, and take practical steps to correct past violations, within 32 days of receiving notice. Otherwise, all your licences end immediately.

No Liability

As far as the law allows, the software comes as is, without any warranty or condition, and the licensor will not be liable to you for any damages arising out of these terms or the use or nature of the software, under any kind of legal claim.

Definitions

The licensor is Mandeep Singh, and the software is the software the licensor makes available under these terms.

You refers to the individual agreeing to these terms. Only an individual can agree to these terms; an organisation cannot.

Your licences are all the licences granted to you for the software under these terms.

Use means anything you do with the software requiring one of your licences.
